By purchasing goods or using services on our website, you agree to be bound by these Terms & Conditions ("Terms"), together with our Privacy Policy and any other policies referenced on our website. If you do not agree with these Terms, please do not use our website or purchase from us.
1. Definitions
"Lincolnshire Vapours", "we", "us" or "our" means Lincolnshire Vapours LTD, registered in England and Wales under company number 10030077.
"You" or "your" means the person ordering or purchasing goods or services from us.
"Goods" means any products purchased from us.
"Services" means any services provided by us, including delivery services where applicable.

2. General
2.1. Our website is intended for customers aged 18 or over.
2.2. By placing an order, you confirm that you are at least 18 years old and legally entitled to purchase the Goods ordered.
2.3. We reserve the right to request age verification or other identification where reasonably necessary.
2.4. We reserve the right to refuse or cancel an order where we have reasonable grounds to believe that the customer is under 18, has provided false information, or otherwise does not meet our purchasing requirements.
2.5. Nothing in these Terms is intended to limit or exclude any statutory rights you have under applicable UK consumer law.
3. Orders
3.1. When you place an order through our website, you are making an offer to purchase the Goods listed in your order.
3.2. An automated order confirmation confirms that we have received your order but does not necessarily mean that your order has been accepted.
3.3. A contract for the sale of Goods is formed when we accept your order, normally when we dispatch the Goods or otherwise confirm acceptance.
3.4. We reserve the right to refuse, restrict or cancel an order where there is a genuine pricing or product error, stock issue, suspected fraudulent activity, suspected resale or other legitimate reason.
3.5. If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.
3.6. We may contact you if there is an issue with your order, including where additional information is required to process or deliver it.
4. Product Information, Errors and Inaccuracies
4.1. We make reasonable efforts to ensure that product descriptions, images, prices, availability and other information displayed on our website are accurate.
4.2. Occasionally, errors or inaccuracies may occur. We reserve the right to correct genuine errors or omissions and to update product information where necessary.
4.3. Where an error materially affects an order that has not yet been fulfilled, we may contact you to discuss the issue or cancel the affected order and provide an appropriate refund.
4.4. Product images are for illustration purposes and may differ slightly from the actual product due to manufacturer packaging changes, screen settings or other circumstances.
4.5. Manufacturer specifications may change from time to time. Where a manufacturer makes a genuine change to a product, we will endeavour to ensure that the product supplied remains as described.
5. Prices and Payment
5.1. All prices displayed on our website are in pounds sterling (£) and include VAT where applicable.
5.2. Delivery charges are displayed separately where applicable and will be shown before you complete your purchase.
5.3. Payment must be authorised and successfully received before an order is dispatched.
5.4. We reserve the right to carry out appropriate payment and fraud-prevention checks.
5.5. Ownership of the Goods will pass to you once full payment has been received and the Goods have been delivered to you, subject to any rights or remedies available under UK law.
6. Cancellation, Returns, Refunds and Exchanges
6.1. If you purchase Goods from us online, you may have a statutory right to cancel your order under the Consumer Contracts Regulations 2013. Where this statutory cancellation right applies, you normally have 14 days from the day after receiving the Goods to notify us that you wish to cancel.
6.2. After notifying us that you wish to cancel under the statutory cancellation right, the Goods must normally be returned within a further 14 days.
6.3. Certain Goods may be excluded from the statutory cancellation right where permitted by law. This may include sealed Goods which are not suitable for return for reasons of health protection or hygiene once they have been unsealed.
6.4. Where Goods are returned under a statutory cancellation right, they should be returned in an unused condition and with their original packaging where reasonably possible. You may be responsible for any diminished value caused by handling the Goods beyond what is reasonably necessary to establish their nature, characteristics and functioning.
6.5. Where a statutory cancellation right applies, we will process any refund in accordance with applicable law. This may include the cost of standard delivery originally paid by you, where required by law. We may withhold the refund until we receive the returned Goods or you provide evidence that they have been returned, whichever occurs first.
6.6. Nothing in this section affects your statutory rights where Goods are faulty, not as described, not fit for purpose or otherwise fail to meet the requirements of applicable consumer law.
Missing, Short-Supplied, Incorrect or Damaged Goods
6.7. Customers should check their order as soon as reasonably possible following delivery to ensure that the Goods received correspond with the order placed, including the products and quantities ordered.
6.8. Any missing, short-supplied, incorrect or damaged Goods should be reported to Lincolnshire Vapours as soon as reasonably possible and, wherever possible, within 30 days of delivery.
6.9. When reporting an order discrepancy, you should provide your order number and details of the issue. We may reasonably request photographs or other information where this is necessary to assist us in investigating the matter.
6.10. Where a discrepancy is reported more than 30 days after delivery, Lincolnshire Vapours reserves the right to decline the claim where the circumstances cannot reasonably be verified, particularly where there is insufficient evidence to establish that the discrepancy existed at the time of delivery.
6.11. Where appropriate, we may investigate reported discrepancies using available order records, packing records, stock records, delivery information and any other relevant information available to us.
6.12. The 30-day notification period is intended to allow us to investigate order discrepancies while relevant records and information are reasonably available. It does not remove or restrict any statutory rights or remedies available to consumers under applicable UK law.
Faulty Goods
6.13. If a product is faulty, damaged or otherwise does not meet the requirements of applicable consumer law, please contact us as soon as reasonably possible so that we can investigate the issue and provide the appropriate remedy.
6.14. Depending on the circumstances and applicable law, the appropriate remedy may include a repair, replacement, price reduction or refund.
6.15. Damage caused by misuse, accidental damage, unauthorised modification, normal wear and tear or failure to use a product in accordance with the manufacturer's instructions may not be covered.
6.16. Where a manufacturer warranty applies, this is in addition to, and does not replace, your statutory rights against us.
Returns Postage
6.17. Where you are exercising a statutory cancellation right because you have changed your mind, you are normally responsible for the cost of returning the Goods unless we have agreed otherwise or applicable law requires us to cover the cost.
6.18. Where Goods are faulty, damaged, incorrect or otherwise do not conform to your statutory rights, we will deal with return postage in accordance with the circumstances and applicable law.
6.19. We recommend using a tracked delivery service when returning Goods and retaining proof of postage.
7. Personal Information
7.1. We collect and process personal information in accordance with our Privacy Policy.
7.2. Personal information is used where necessary to process orders, provide services, communicate with customers, prevent fraud and meet our legal obligations.
7.3. You are responsible for ensuring that the personal information provided to us is accurate and up to date.
8. Limitation of Liability
8.1. Nothing in these Terms excludes or limits liability where doing so would be unlawful.
8.2. We are not responsible for losses that are not reasonably foreseeable or for losses arising from circumstances outside our reasonable control.
8.3. Nothing in these Terms affects your statutory rights as a consumer.
9. Age Requirements
9.1. Products sold through our website may only be purchased by persons aged 18 or over.
9.2. We may use appropriate age-verification procedures where necessary.
9.3. If an order is placed by a person under 18 or we are unable to reasonably establish that the purchaser meets the applicable age requirement, we may cancel the order.
10. Product Warnings and Regulations
10.1. Customers are responsible for using Goods in accordance with applicable instructions and warnings supplied with the product.
10.2. Products containing nicotine are intended only for persons aged 18 or over.
10.3. Customers should follow all manufacturer instructions and safety information supplied with products.
11. Sale, Clearance and Discounted Goods
11.1. Sale, clearance and heavily discounted Goods may be discontinued, end-of-line, clearance or otherwise offered at a significantly reduced price.
11.2. Unless otherwise stated, sale, clearance and heavily discounted Goods are not eligible for return or exchange where the customer has simply changed their mind or no longer wants the Goods.
11.3. A reduced price does not remove any statutory consumer rights. Where Goods are faulty, defective, not as described, not fit for purpose or otherwise fail to meet the requirements of applicable UK consumer law, the customer may still have a legal right to an appropriate remedy.
11.4. Where a product has been reduced because of a specific defect, cosmetic issue, packaging damage or other condition that was clearly disclosed to the customer before purchase, that disclosed issue will be taken into account when determining whether the Goods meet the description provided at the time of purchase.
11.5. Nothing in this section limits or excludes any statutory rights that cannot lawfully be limited or excluded.

12.2. We are not responsible for the content, availability or operation of third-party websites or services.
12.3. Third-party services used to process payments, deliveries or other aspects of an order may have their own terms and privacy policies.

20.3. Changes will not retrospectively remove rights that you have already acquired under applicable law.
