1. Definitions {#definitions}

  • “Lincolnshire Vapours” / “we” / “us” / “our” – Lincolnshire Vapours LTD, registered in England and Wales (company number 10030077), including any holding or subsidiary companies, with registered office at Shop 19, The Vape Store Boston, Waterfall Plaza, Bank Street, Boston, Lincolnshire PE21 6DY.

  • “You” / “Your” – the person ordering or purchasing goods or services from us.

  • “Goods” – any products you purchase from us.

  • “Services” – any services you order or purchase through our website.

  • “Personal Information” – details you provide to us when using our Services.

  • “Website” – any part of www.lincolnshirevapours.co.uk

  • “Conditions” / “Terms” – these Terms of Service.

2. Rights and Obligations {#rights-and-obligations}

Your Responsibilities {#your-responsibilities}

By using our Services and purchasing Goods, you agree to:

  • Pay all amounts due promptly.

  • Ensure all Personal Information you provide is true, accurate, and up to date.

  • Notify us immediately of any changes to your Personal Information.

  • Not impersonate any person or entity, or use a false name.

  • Ensure all Goods are used only by persons over 18 years of age.

Our Rights {#our-rights}

  • We may modify prices or withdraw some or all Goods temporarily or permanently.

  • We may change these Terms from time to time; changes will apply to any orders not yet fulfilled, unless legally required otherwise.

  • Goods specifications may change to comply with safety standards or manufacturer updates. We will endeavour to ensure such changes do not reduce quality or performance, and will notify you if substantial changes affect orders already placed.

Delivery & Export Compliance {#delivery-and-export-compliance}

  • Delivery timeframes are estimates only; delays may occur due to circumstances beyond our control.

  • Goods may be subject to EU, UK, and US export laws. You must not purchase Goods for restricted end-users or prohibited uses (e.g., WMD development).

3. Orders {#orders}

  • Goods are only available to individuals we consider eligible (residents of Europe and the UK, aged 18+).

  • Orders are treated as offers to purchase. A contract is completed when we dispatch the Goods or take payment.

  • Automated order confirmations do not constitute acceptance.

  • We may limit, restrict, or cancel orders at our discretion, including suspected errors or commercial resale purposes.

4. Errors, Inaccuracies and Omissions {#errors-inaccuracies-and-omissions}

  • Product information, pricing, promotions, shipping charges, and availability may contain errors.

  • We reserve the right to correct errors and cancel or update orders if information is inaccurate, without prior notice.

  • We are not obliged to update content unless required by law.

5. Prices and Payment {#prices-and-payment}

  • Prices include VAT at the current rate (excluding wholesale VAT).

  • Payment methods must belong to you and are subject to validation and authorisation.

  • Ownership of Goods transfers only once payment is received in full. Until then, Goods remain our property, and you must keep them safe and identifiable as such.

  • Orders may be subject to cross-border checks or additional charges, which you are responsible for.

6. Cancellation, Returns, and Exchanges {#cancellation-returns-and-exchanges}

  • Either party may terminate these Terms with 7 days’ written notice in the event of a material breach.

  • Refunds or exchanges may be given at our discretion. Consumers cancelling orders have 14 days from receipt (except for perishable or opened items) to return Goods in original condition.

  • Used or damaged Goods may be charged at full cost.

  • Returned Goods must be sent to our store at your cost unless collection is arranged. Use tracked or signed delivery where possible.

7. Personal Information {#personal-information}

  • We collect Personal Information to provide Goods and Services.

  • Processing of Personal Information follows our GDPR-compliant Privacy Policy.

  • You may consent to marketing communications and can opt out at any time.

  • You may request account deletion, with orders disassociated but retained for legal purposes.

  • You may request physical copies of any Personal Information we hold about you.

8. Limitation of Liability {#limitation-of-liability}

  • We are not liable for loss or damage unless caused by our breach of a legal duty.

  • Liability does not cover business losses, lost profits, data loss, or business interruption.

  • Nothing limits liability for death or personal injury due to negligence, or consumer statutory rights.

  • Goods are subject to manufacturer warranties, in addition to your statutory rights.

  • Each clause in this section operates independently; invalidity of one part does not affect others.

9. Age of Consent {#age-of-consent}

  • Products may only be purchased by persons aged 18+.

  • Age may be verified using third-party services (e.g., Experian).

  • False age declarations may result in cancellation and liability for all associated costs or penalties.

10. Product Warnings, Regulations & Seizures {#product-warnings-regulations-and-seizures}

  • Products will have UK-compliant plugs and packaging.

  • Responsibility for international compliance, customs fees, or seized orders lies with the buyer.

  • We package products to minimise customs issues but cannot guarantee delivery outside the UK.

11. Sales, Clearance, and Discounted Items {#sales-clearance-and-discounted-items}

  • Discounted or clearance e-liquids may be near or past manufacturer expiry.

  • Liability for use of such products rests entirely with the purchaser.

12. Shopify Integration, Optional Tools, and Third-Party Links {#shopify-integration-optional-tools-and-third-party-links}

  • The store is powered by Shopify; Shopify facilitates the Services but is not responsible for sales, products, or disputes.

  • Optional third-party tools may be provided; use is at your own risk.

  • Third-party links are provided for convenience; we are not responsible for external content or transactions.

13. Intellectual Property {#intellectual-property}

  • All content, design, trademarks, and branding are owned by Lincolnshire Vapours, Shopify, or licensors.

  • Content is for personal, non-commercial use only. Unauthorized use may violate IP laws.

14. Feedback {#feedback}

  • Feedback submitted grants Lincolnshire Vapours a perpetual, royalty-free license to use and adapt it for any purpose.

  • You represent that you own the rights to any feedback submitted.

    • Violate laws or regulations.

    • Harass, defame, or impersonate others.

    • Transmit malware, spam, or malicious code.

  • Severability: If a clause is invalid, remaining clauses remain enforceable.

  • Waiver: Failure to enforce a right does not waive it.

  • Entire Agreement: These Terms, including linked policies, constitute the entire agreement.

  • Assignment: You may not transfer rights; we may assign freely.

  • Governing Law: English law applies. Any disputes must be resolved in UK courts.

  • Headings: Provided for convenience and do not affect interpretation.
